What is extrajudicial?

An extrajudicial document is a document drawn up by a lawyer, in the form of a letter, and delivered to the addressee by a bailiff, usually at his home, so that he is sure to be informed.

The extrajudicial order is communicated by a natural or legal person to another through a bailiff, with a confirmed date and time of receipt, in order to prove in writing, through the bailiff's service report, that the recipient was aware of this document, so that he cannot to be disputed neither on the one hand that the "sender" stated to him what is contained in the extra-judicial, but nor on the other hand that the "recipient" was aware of this.

Regarding the content of an extrajudicial, this cannot be limited, as depending on the case or the nature of the case, this can be different.

The out-of-court notice is a very useful and at the same time economical means to notify the recipient of anything that concerns you. Extrajudicial advantages:

  • It gives the message to the recipient that your case is now being taken over by a lawyer, therefore you intend to go to court as well, with the corresponding costs arising for both sides.
  • It is delivered by a bailiff personally to the recipient, so it contains elements of publicity, which acts as a means of pressure.
  • It acts as the recipient's first "disturbance" in the event of a Court hearing, thus strengthening your case file,
  • In many cases it is considered as the last attempt to resolve the dispute out of court before the parties go to court.
